Legal malpractice occurs when an attorney's negligence — or, in some cases, intentional misconduct — injures the client they were supposed to protect. A missed deadline, an unresolved conflict of interest, or advice that falls below the standard of care can cost a client their case, their money, or rights they can never recover.
To succeed on a legal malpractice claim in Kansas or Missouri, a client generally must show that an attorney-client relationship existed, that the attorney was negligent, that the negligence caused the client's injury, and that the underlying case would have succeeded but for the attorney's conduct. That last element is often the hardest to prove, which is why experienced trial counsel matters.
